INDIAN CONSTITUTIONAL LAW: APPLICATION OF ANALYTICAL SCHOOL John Austin is the inspiration of the Analytical School, which in turn drew his inspiration from Hobbes, and Bentham. According to Austin law is a command given by a superior to an inferior and enforced by material sanctions. Positive law is a creation of sovereign. It emphasizes that the sovereign is a superior and commands of the sovereign is law, and disobedience of commands is accompanied by punishment. Law is the expression of the absolute and unitary sovereignty of the State. Under the Constitution, Parliament of India can make laws on income-tax and provide that not following those law shall be punished by the fine or imprisonment, or both. Austin’s critics ask, how customs can be resigned with the theory of command, and where we can find a supreme law-giver in a nascent society. The concept of fundamental rights and their enforcement mechanism is an example of supreme law. Their efforts were crowned with success, and Naoroji became the first Indian to sit in the House of Commons. When Jinnah returned to Karachi in 1896, he found that his father’s business had suffered losses and that he now had to depend on himself. He decided to start his legal practice in Bombay, but it took him years of work to establish himself as a lawyer. It was nearly 10 years later that he turned toward active politics. A man without hobbies, his interest became divided between law and politics. Nor was he a religious zealot: he was a Muslim in a broad sense and had little to do with group discussion about Islam. His interest in women was also limited to Ruttenbai, the daughter of Sir Dinshaw Petit, a Bombay Parsi millionaire–whom he married over tremendous opposition from her parents and others. The marriage proved an unhappy one. It was his sister Fatima who gave him solace and company. Jinnah first entered politics by participating in the 1906 Calcutta session of the Indian National Congress, Jinnah did not favour totally in Independence, he considered British influences on education, law, culture and industry as beneficial to India. Jinnah became a member on the sixty-member Imperial Legislative Council. Four years later he was elected one of the sixty-member Imperial Legislative Council, then he was appointed to the Sandhurst committee, which helped to establish the Indian Military Academy at Dehra Dun. During World War I, Jinnah joined other Indian moderates in supporting the British war effort, hoping that Indians would be rewarded with political freedoms. He admired the British political system to raise the status of India in the international community and to develop a sense of Indian nationhood among the peoples of India. At that time, he still looked upon Muslim interests in the context of Indian nationalism. But, by the beginning of the 20th century, the belief had been growing among the Muslims that their interests demanded the preservation of their separate identity rather than live mixed with in the Indian nation, it is impossible for Muslims to be with Hindus. All-India Muslim League was founded in 1906. But Jinnah was initially avoiding to join it because it was too Muslim oriented. Eventually, he joined the league in 1913 and he became its chief organizer in 1916 at Bombay and was elected president of the Bombay branch. To bring about such a rapprochement was Jinnah’s chief purpose during the late 1920s and early 1930s. He worked toward this end within the legislative assembly, at the Round Table Conferences in London (1930-32), and through his 14 points, which included proposals for a federal form of government, greater rights for minorities, one-third representation for Muslims in the central legislature, separation of the predominantly Muslim Sindh region from the rest of the Bombay province, and the introduction of reforms in the north-west Frontier Province. But he failed. His failure to bring about even minor amendments in the Nehru Committee proposals (1928) over the question of separate electorates and reservation of seats for Muslims in the legislatures frustrated him. He found himself in an odd position at this time; many Muslims thought that he was too nationalistic in his policy and that Muslim interests were not safe in his hands, while the Indian National Congress would not even meet the moderate Muslim demands halfway. Indeed, the Muslim League was a house divided against itself. The Punjab Muslim League repudiated Jinnah’s leadership and organized itself separately. In this unwillingness, Jinnah decided to settle in England. From 1930 to 1935 he remained in London, devoting himself to practice before the Privy Council. But when constitutional changes were in the offing, he was persuaded to return home to reorganize the Muslim League. Soon preparations started for the elections under the Government of India Act of 1935. Jinnah was still thinking in terms of co-operation between the Muslim League and the Hindu Congress and with coalition governments in the provinces. But the elections of 1937 proved to be a turning point in the relations between the two organizations The Congress obtained an absolute majority in six provinces, and the league did not do particularly well. The Congress decided not to include the league in the formation of provincial governments, and all-Congress governments were excluded. Jinnah had originally been unreliable about the practicability of Pakistan, An idea that Sir Muhammad Iqbal had proposed to the Muslim League conference of 1930, but before long he became convinced that a Muslim homeland on the Indian subcontinent was the only way of safeguarding Muslim interests and the Muslim way of life. It was not religious persecution that he feared so much as the future exclusion of Muslims from all prospects of advancement within India as soon as power became vested in the close-knit structure of Hindu social organization. To guard against this danger he carried on a nation-wide campaign to warn his religion fellows for the serious danger of their position, and he converted the Muslim League into a powerful instrument to unite the Muslims into a nation. The Congress agreed to the division of Punjab and Bengal along religious lines in late 1946. The new viceroy Lord Mountbatten and Indian civil servant V. P. Menon proposed a plan that would create a Muslim dominion in West Punjab, East Bengal, Baluchistan and Sindh. After heated and emotional debate, the Congress approved the plan. The North-West Frontier Province voted to join Pakistan in a referendum in July 1947. Jinnah asserted in a speech in Lahore on October 30, 1947 that the League had accepted independence of Pakistan because â€Å"the consequences of any other alternative would have been too disastrous to imagine†. Jinnah led his movement with such skill and tenacity that ultimately both the Congress and the British government had no option but to agree to the partitioning of India. Pakistan thus emerged as an independent state in 14th August, 1947. Jinnah became the first head of the new state ‘Pakistan’. He took oath as the first governor general on August 15, 1947. Faced with the serious problems of a young nation, he tackled Pakistan’s problems with authority. Attempting to recuperate, he spent many months at his official retreat in Ziarat, but died on September 11, 1948 (just over a year after independence) from a combination of tuberculosis and lung cancer. His funeral was followed by the construction of a massive mausoleum (Mazar-e-Quaid) in Karachi to honour him; official and military ceremonies are hosted there on special occasions. The Agha Khan considered him â€Å"the greatest man he ever met†, Beverley Nichols, the author of `Verdict on India’, called him â€Å"the most important man in Asia†, and Dr. Kailashnath Katju, the West Bengal Governor in 1948, thought of him as â€Å"an outstanding figure of this century not only in India, but in the whole world†. While Abdul Rahman Azzam Pasha, Secretary General of the Arab League, called him â€Å"one of the greatest leaders in the Muslim world†, the Grand Mufti of Palestine considered his death as a â€Å"great loss† to the entire world of Islam. Her feet are locked in, pushing against the wooden bar beneath and as she throws her body forward; the stool begins to rock back and forth. In a wave-like motion, she leans back as the stool tips forward, riding the chair like a rocking horse. Slowly she picks up pace, tilting forward and back, until the feet of the stool are only touching the ground two at a time. She rocks faster and faster, her eyes locked on the blank TV sitting directly ahead as it rhythmically gets closer then farther away. Several studies conducted concerning pain management and quality of life for sickle cell disease patients indicate additional studies needed. Identifying additional effective complementary alternate therapies is vital for a more improved quality of life. This will be necessary in order to reduce the number of painful episodes experienced by the sickle cell patient. Sickle cell disease is a genetic disorder of the red blood cells and further characterized by painful acute vaso-occlusive episodes where the sickle cell is stuck in the blood vessels, blocking the blood flow. This is one of the most common reasons leading up to hospitalization, the vaso-occlusive episodes. These episodes can lead to ischemia and infarctions over the entire body region with painful recurring, unpredictable, intense, and relentless episodes, lasting approximately 3-14 days (Yaster, Kost-Byerly, Maxwell, 2000). According to Granados and Jacob (2009), the purpose of their study was to examine pain experienced and the effectiveness of analgesics for hospitalized adults with sickle cell disease. The literature review indicates a variety of reasons why inadequate pain management is ongoing in the adult (SCD) patients admitted with vaso-occlusive episodes. The focus is mainly on factors that affect the management of pain, including methods of analgesic administration, and non-pharmacologic regimens, therefore the perception of the provider is important in regards to treating sickle cell pain as identified in the study by (Shapiro, Benjamin, Payne Heidrich, 1997; Steinberg, 1999; Yale et al. , 2000). Little attention in the way of research studies has been examined in relation to the pain experience of the sickle cell adults. Ballas and Lusardi (2005) evaluated the sequence of hospital admissions of patients with sickle cell disease, reviewing the causes of recurring admissions, and the importance of the patient’s outcome of illness. All readmissions examined specifically within seven to thirty days from the initial admission discharge assessing for the rationale of the recurrence of hospital admission and relation to the prognosis of the sickle cell disease patient. The researchers evaluated the pain by a descriptive underlying research design knowledgeable by the sickle cell disease patients for intensity, location, and quality of pain. Fifty percent of patients admitted for intense painful episodes were readmitted within one month after discharge, and another estimated 16% were readmitted within one week after discharge. Severe pain is described as a degree of pain greater than six on a zero to ten numerical rating scales. A mean score of seven or greater indicates prematurity in discharging the sickle cell disease patients from the hospital. In conclusion, the patients admitted to the hospital with high pain scores were more likely to have lengthy hospitalizations, and to be discharged home with equally higher pain scores. The pain intensity scores from the previous discharge examined by the researchers indicated 71 readmission, in which 52 patients were readmitted for vaso-occlusive episodes, (Ballas Lusardi, 2005). The pain score of study participants indicated a high pain intensity score, and the scores did not change consequently during prolonged episodes. Even higher pain intensity more so on days seven and eight were indicated for increase pain significance. Researchers further indicated that the main reason for hospital readmissions were early discharge to home settings, signs and symptoms of medication/drug withdrawal, that brought about the intense reoccurring episodes of vaso-occlusive illnesses. It was noted that readmissions to the hospital for the adult sickle cell disease patient is more common and researchers recommended future studies for improvement in pain management in the hospital and at home. In future studies, researchers will need to use a larger sample size to evaluate patterns of pain management, effectiveness and influence on quality of life in the sickle cell disease patient. Although, no evidence was identified where upward titration of analgesics was done it is recommended that development of algorithms be encouraged to help carefully plan decisions regarding titration of medications in adult patients with sickle cell disease during hospitalizations. Jiles and Morris, (2008) made known in their descriptive study of 62 patients (18 years of age and older) using Burckhardt and Anderson’s 16 item self-report and a demographic uestionnaire used for data collection. The purpose of the study was to investigate the quality of life in adults with sickle cell anemia, hemoglobin SC, or Hemoglobin S beta thalassemia. The results revealed that the healthy populations average scores for quality of life scale is 90 and in this study the overall mean QOL score was 83. 6 ( SD=13. 2) lower than those of the overall general population. The outcome of this study indicated additional research is necessary to advance the understanding of the factors that greatly affect quality of life in the management of sickle cell disease in order for patients to enjoy normal activities of life. A cross sectional descriptive study conducted by Yoon and Black (2006) researched both pharmacologic and complementary therapies used for pain management by caregivers of children with sickle cell disease (SCD). They further studied the prevalence and types of complementary therapies used for pain management by caregivers of children with SCD and made inquiries of caregivers’ concerning their interests in using complementary therapies in the future. Since there was no obtainable questionnaire to meet the principle of the study, a questionnaire was created by the chief researcher. Items included on the questionnaire was age of child, age of caregiver, use of analgesic, annual income estimate, caregivers educational level, and type of health insurance their child had available. Divisions were randomly ordered and included massage, chiropractic, acupuncture, energy healing, relaxation techniques, imagery, meditation, hypnosis, biofeedback, self-prayer, spiritual healing by others, music therapy, herbal or fold remedies, megavitiamins, yoga, tai chi and other body works, and transcutaneous electrical nerve stimulation. The prospective patients were identified, approached, and invited to participate in the study by the clinical coordinator of the sickle cell disease clinic. The study was explained and potential participants were provided an informed consent letter. All subjects were provided a room for privacy and questionnaires were completed either by the caregivers of the participants or by the research assistance. The research assistant was nearby in either case to answer any questions that might arise by the caregivers when completing his/her form. The instructions provided to the caregivers indicated the questionnaires listing of the sixteen complementary therapies. The caregivers were to indicate any usage of them within the last six months and were asked would they be interested in using any of the listed complementary therapies in the future. Statistical analyses was used including how often an event repeats itself over a set amount of time and expected values with standard deviations, were used to compare demographic variables, research use of pharmacological therapies for pain management between age groups, and evaluate pharmacologic/analgesic and complementary therapy use. Chi-square tests were done in the beginning of the study and carried through to completion comparing the demographic variables, scrutinized use of pharmacologic therapies for pain management between age groups, and compared use of pharmacologic and complementary therapies. The results of the most frequently used pain medication for children revealed a mean age of 9 years. The results indicated children using pain medications most frequently identified was ibuprofen (37. 5%), acetaminophen with codeine (32. 1%), and acetaminophen with oxycodone (14. 5%). Complementary and alternative medicine use among children as well as adults has increased in the last ten years. In the study, caregivers with a mean age of 33 years was 70% of the 63 caregivers identified as using some form of complementary therapy. African American mothers made up 79% of the predominant race of caregivers and (56. 9%) indicated an annual income less than $20,000. Sixty percent of caregivers had twelve years of education or less, and twenty-four percent reported at least 2 years of college education. Medicaid (76%) was the major source of coverage for the children, although 24% had private or other identifying insurance. Future studies should include investigating the safety and effectiveness of the most commonly used complementary therapies reported in this study as well as recognizing possible ways complementary and alternative medicine (CAM) may be used effectively with pharmacologic therapies for pain management in children with Sickle cell disease in order to offer greater longevity and overall improved quality of life. Yoon and Black (2006), Jiles and Morris (2008) and Granados and Jacob (2009) all indicate the need for future studies in management of pain in the sickle cell disease patients. All studies indicate that the genetic disorder most commonly found in the African- American affects approximately 70,000 in the United States. This genetic disorder affects the red blood cells causing a stasis of sickle shaped erythrocytes, in which occlusion of the cells microcirculation, causing ischemia, and infarction. These recurring, unpredictable, intensified, and persistent painful episodes prevent stability and overall quality of life in the sickle cell disease patient and all authors indicate the need for future studies. The purpose of this review of literature is to identify all of the effective therapies of pain management for sickle cell disease patients. Whether the therapies used are complementary or alternative therapies vs. analgesic regimens. There must be future studies to seek out the answers for improved methods of pain treatment in order to improve the quality of life for the patients with sickle cell disease to exceed living past the age of forty-two with an increased zest and quality of life. I decided to conduct my study from 1936 to 1960. For this 25-year period I found all the statistical data which I need to actually complete population growth analysis. In the demographic transition model of Argentina we can see that the crude birth rate (CBR) is almost always double or higher then the crude death rate (CDR). This allows the natural rate of increase (NRI) to be higher than the CDR. NRI reflects how fast population is growing. In the demographic transition model of Argentinas CBR per 1000 (blue line) is the highest line relative to the origin. We can see that the line stays very steady from 1936 to 1943, at about 22 to 23 live birth per thousand. In 1944 we see a gradual increases of live birth per thousand. By 1946 the CBR is at one of it highest points. This line fluctuate from 24 to 25 per thousands range for approximately twelve years to 1956 until it gradual decrease to it original state, back to 22 per thousands. The ten to twelve years peak period of CBR helps to increases NRI for Argentina in the mid 40s and into the 50s. (We will see how this effects the NRI later) The CDR (pink line) is the lowest line in the model. In the beginning of the line (1936) we see the CDR start to rise and reach it highest point at 11 per thousand in 1938. From then on it stay steady at 10 per thousands for nine years. After 1948 we can see the line slowly decreasing to 8 per thousand by 1960. This slow drop in CDR also effected the NRI (which we will see later). Both CBR and CDR effect how well a country like Argentina population is growing both factors relate to the natural rate of increase. This is the middle line in the model (yellow line). The NRI is determined by subtracting the CBR by the CDR. In the model Argentinas CBR is fairly high and CDR is less than half of it. This allows the NRI line to stay between them. We can see from the model that the NRI starts to decrease from 1936 to 1938. This is happens because the CDR rises and the CBR remands steady. In 1938 the NRI reaches it lowest level at 11 per thousand. From that point on we see an increase of the NRI. NRI increase because of the growth in CBR and the slow decrease in CDR. The NRI reaches it highest point of 16 per thousand in 1950 and from than on decrease gradually. It gradually decreases because both CBR and CDR are also decreasing. By looking at NRI we see point of high population increase was from 1944 to 1956 this time period is better known as the baby boom. From the m odel we see that Argentinas NRI is in the middle range of population growth from 12 to 16 per thousand, which is 1.2 to 1.6 percent increase per year. Form the demographic transition model of Argentina I see no discernable pattern. But I do feel that by looking at the demographic transition model of Argentinas that it falls under the second stage of the model. This stage is where growth potential is realized and where CDR drops before CBR, which allow for rapid population growth. I also found it not to fit the pattern of the pioneer countries. The reason for this is that Argentina didnt keep fertility and the mortally level relatively low like the pioneers. We can see this by have the NRI over one percent. The demographic gap is the gap between the live birth rate and death rates in the demographic transition model. The larger the gap between lines (providing CBR is high the CDR) will determine the growth rate of a country. In my case study of Argentina as a developing country it imply that the future growth will remain relatively the same. Elizabeths portraits were very important and she wanted them to show five main things: * Strength and power: She wanted to show than she was ruling the country wisely and successfully. * Wealth: It was important to distinguish Queens financial difficulties. * Ageless: As Elizabeth grew older, it was important to hide signs of age because this is a sign of weakness. * Success and wisdom: Elizabeth wanted her paintings to show that she was strong and powerful. She often had symbols of strength in her paintings such as pillars. * Legitimacy and purity: Roman Catholics thought that Queen Elizabeth had no right tot be Queen and was illegitimate. Therefore, to show her purity her face and clothes were usually white. Elizabeths portraits and coronation showed her as a successful ruler but even good publicity cold not distinguish failures. In addition, Elizabeths success would depend on how well she governed the country. She also needed to win the support of her wealthy and powerful. The Queen was the most important member of the court. Elizabeth used patronage, which is the power to appoint people to important jobs. This is how she attracted the loyalty and support of her most important subjects. I think that Queen Elizabeths ways of peoples support were very successful. For example, the system of patronage was effective as this gave people jobs, which was what they wanted, she made them respect her by making herself the most important person in court and the person with the most power over decisions. Elizabeth chose and controlled her privy council. By January 1559, Elizabeth had appointed nineteen experienced men to her privy council. None were strong Catholics and she appointed William Cecil as her secretary of state the most important position on the Privy Council. Sir William Cecil (secretary of state): He was hard working and he knew about all government business. He was not afraid to disagree with the Queen or others on the Privy Council. Queen Elizabeth trusted him completely and he was a loyal adviser to her for forty years. Robert Dudley (Earl of Leicester): He disliked Cecil and often disagreed with him. He was a loyal advisor to the Queen but they had several quarrels. Sir Christopher Hatton (Parliament): Organised the Queens progresses and was elected into parliament several times. Helped Elizabeth to pass laws and control MPs. Also made lord councillor, in charge of judges and law courts. Sir Francis Walsingham (Secretary of State): Worked mainly on foreign affairs. He was put in charge of Elizabeths secret service controlled a number of spies all over Europe. Also often disagreed with Cecil, and he often made Elizabeth angry but she knew he was completely loyal. He found evidence in 1586 Mary Queen of Scots was involved in a plot to kill the Queen. Robert Devereux: commanded attacks on Spain and Ireland. Often argued with Elizabeth. In 1601, he led a rebellion and was executed for treason. The Privy Council met nearly every day and although Elizabeth didnt go to all meetings. She was determined to show that she was a cautious ruler. She didnt like making big changes or being rushed into making decisions. This often frustrated her councillors but they were completely loyal to her apart for two exceptions: Duke of Norfolk Earl of Essex I think that this aspect of the government was very effective and successful as they helped Elizabeth and they were nearly all completely loyal to her apart from two people (mentioned above). I think that this was successful because she let all the members know who was boss and was not rushed into anything. She also chose her members very wisely and each member had their own speciality. Parliament in the sixteenth century was much less powerful than it was today. It could only meet when the monarch called it. Although Elizabeth didnt have to call the call parliament at all and she could close it whenever she liked. She chose to call in only thirteen times in her forty-five year reign. Elizabeth only called parliament for three main reasons: * To help pass ACTS OF PARLIAMENT laws which were approved by both house of parliament and the monarch. * To approve taxes, which could only be collected if parliament agreed to them? * To provide her with support and advice It was very useful for monarchs to know the opinion of MPs and win there support. This part of the government was not as important to Elizabeth as the Privy Council. I think that she did not like opening and going to parliament but she had to in order to get what she wanted. I think she just used parliament for her own needs. Although she was pretty, effective at getting what she wanted from them. Elizabeth never explained why she didnt marry. Although there were some rumours that she was in love with Robert Dudley and wanted to marry him, there is no evidence to prove this. Elizabeth kept her thought on marriage private. Parliament asked her to marry several times but she only gave a vague answer. Later in the reign, when her MPs asked who was her successor, she always refused. A few things that may have caused her not to marry are: * Marriage might have been unpopular and cause a rebellion * Lose friendship with other countries and become enemies. * If she married an English nobleman her other nobles would be disappointed and start a rebellion. * That she thought her husband would try to take control. Why Elizabeth didnt marry became a mystery and although parliament tried to force the issue of her marrying, she never did. If Elizabeth was going to govern the country successfully, she had to control all her people. This wasnt easy. Elizabeth didnt have a permanent army or a police force to help her. However, Elizabeth appointed officers around the country, to help her control local areas. Also in towns wealthy citizens elected councils to look after the towns affairs and keep the law in order. The local officials with whom most people met were the Justice of the Peace (JPs). Elizabeth elected about forty of them in every county. They were usually landowners who knew there area well. This work was voluntary, however many landowners still wanted to become a JP as it meant that they were the most important person in the area. The Queen expected her Justice of the peace to carry out a range of duties. JP were given more and more work to do during Elizabeths reign. They were often given instruction form the Privy Council to carry out new laws form parliament to enforce. I think that this method was an effective way of keeping the country in order. However, it became less efficient as Elizabeths reign progressed. In addition, Elizabeth had a big enough reputation to persuade people to become JPs voluntarily. Overall, I think that Elizabeths government was very effective. I think she controlled the country well and thorough out her reign there were no wars or rebellions in England and she had a good relationship with other countries. In addition, Elizabeth knew how to get her point across and she made herself the most important person in court and made sure that she was in control and never let anyone take control away for her. Maybe that was the reason that she never married because she was afraid that her husband would try to do so. Also Elizabeth publicised herself well and let people know what qualities she had and let people know that she was suitable for queen as was the right person to run the country.
